Your workouts are always available to view and complete at any time.
Training: GOLDEN HOME FITNESS, INC will provide training to you the following areas: TBD according to your specific goals and objectives.
REFERRALS: Golden will provide YOU one free hour of training for each new Client you refer to Golden. This free session will be earned when the new Client has completed his/her 1st training session.
SESSION CANCELLATION: Conflicts or other issues may arise that require either you or your Trainer to reschedule a training session. In the event you need to cancel a scheduled session please contact your assigned Trainer directly at least 24 hours prior to that session. Make up sessions will not be provided if notice is not given. For Subscription Clients: Missed sessions will never expire, as long as the Client maintains an active contract. You may suspend your account for up to 1 month after which your automatic scheduled invoicing will continue. Longer suspensions may be allowed (up to 3 months) with a valid medical reason. For Ad-hoc Virtual Clients: Missed sessions will be honored for 1 month past the session date.
TARDINESS/NO SHOW: Your Trainer will wait 10 minutes from the start of the scheduled training session for you arrive at your home or other agreed upon training location. If you do not arrive within the 10 minutes, and you have not called the Trainer at least 24 hours in advance to cancel the session, you will be responsible for payment of the session. If you arrive within the 10 minute time period, training will be performed for the remainder of the scheduled session.
COMMUNICATION WITH YOUR TRAINER: At the first training session please be sure to exchange telephone #’s and email addresses with your Trainer. Please contact your Trainer directly in the event there is a need to cancel and/or reschedule a session.
TIPPING YOUR TRAINER: Tipping your professional Golden Home Fitness trainer is NOT encouraged. Please do not tip your GHF Trainer. (applicable only to In Person Training)
SOLICITATION OF GOLDEN TRAINERS: As a Client of Golden, you are not allowed to solicit or contract with a Golden Trainer except through Golden. By proceeding to the payment section, you agree that any violations of this clause will result in a $1000.00 administrative fee. Trainers contracted through Golden have agreed, in writing, that they are not allowed to accept direct employment or referrals from Golden Clients.
TERM: This Agreement Term shall be for an initial 3-month period unless otherwise noted. It will be billed on a monthly basis. This initial 3-month term may be canceled if 1) the Client re-locates outside the GHF service area or 2) has a valid medical excuse. This contract will convert automatically to a monthly term on the 4th month (same day of month as original contract) renewing monthly thereafter. This monthly term contract may be canceled if notice is given in writing (email) at least seven (7) days prior to the monthly renewal date. Please direct your email to your Account Executive.
We very flexible with regards to your ability to cancel your monthly subscription by allowing notification up to 7 days prior to your billing date. However, if you notify us within this 7-day period prior to billing, you invoice will be processed. Once an invoice is processed, there are NO REFUNDS for training hours invoiced.

In agreeing to receive services provided by Golden Home Fitness, Inc., I agree as follows: I fully understand and acknowledge that (a) the activities in which I will engage as part of the fitness program provided by Golden Home Fitness and the physical therapy activities and equipment I may use as a part of those activities have inherent risks, dangers, and hazards and such exists in my use of any equipment and my participation in these activities; (b) my participation in such activities and/or use of such equipment may result in injury or illness including, but not limited to bodily injury, disease, strains, fractures, partial and/or total paralysis, or other ailments that, could cause serious disability or death; (c) these risks and dangers may be caused by the negligence of the representatives or employees of Golden Home Fitness, Inc., the negligence of the participants, the negligence of others, accidents, breaches of contract, or other causes. By my participation in these activities and for use of equipment, I hereby assume all risks and dangers and all responsibility for any losses and/or damages whether caused in whole or in part by the negligence or the conduct of the representatives or employees of Golden Home Fitness, Inc., or by any other person. I, on behalf of myself, my personal representatives, my spouse and my heirs, hereby voluntarily agree to release, waive, discharge, hold harmless, defend, and indemnify Golden Home Fitness, Inc. and their representatives, employees, contractors and assigns from any and all claims, actions or losses for bodily injury, property damage, wrongful death, loss of services or otherwise which may arise out of my use of any equipment or participation in these activities. I specifically understand that I am releasing, discharging, and waiving any claims or actions that I may have presently or in the future for the negligent acts or other conduct by the representatives or employees of Golden Home Fitness, Inc. I recognize that there is a risk involved in the types of activities offered by Golden Home Fitness. Therefore, I accept all responsibility including financial for any injury that I may cause either to myself or to any other participant or trainer due to my negligence. Should the above-mentioned parties, or anyone acting on their behalf, be required to incur attorney’s fees and costs to enforce this agreement, I agree to reimburse them for such fees and costs. I further agree to indemnify and hold harmless Golden Home Fitness, their principals, agents, employees, and volunteers from liability for the injury or death of any person(s) and damage to property that may result from my negligent or intentional act or omission while participating in activities offered by Golden Home Fitness. This includes but is not limited to common areas of a condo/apartment building, parks, recreational areas, playgrounds, areas adjacent to client’s home, and/or any area selected for training by Golden Home Fitness. I hereby affirm that I am in good physical condition and do not suffer from any known disability or condition which would prevent or limit my participation in this exercise program. I confirm that I have completed the Golden Home Fitness Personal Profile form and all information on the form is accurate and truthful. I have been advised that an examination by a physician should be obtained by anyone prior to commencing a fitness and/or exercise program or initiating a substantial change in the amount of regular physical activity performed. If I have chosen not to obtain a physician’s consent prior to beginning this fitness program, I hereby agree that I am doing so solely at my own risk. I understand that it is my sole responsibility to participate in exercises that are appropriate for the current status of my health. If I have any questions or concerns about whether or not a particular activity is appropriate to my current health status, I understand it is my responsibility to ask my doctor if this activity is appropriate before I participate in such activity. I will advise my trainer or Golden Home Fitness if anything changes with my health.
I HAVE READ THE ABOVE WAIVER AND TOS AND BY PROCEEDING WITH PAYMENT, I AGREE. IT IS MY INTENTION TO EXEMPT AND RELIEVE GOLDEN HOME FITNESS FROM LIABILITY FOR PERSONAL INJURY, PROPERTY DAMAGE OR WRONGFUL DEATH CAUSED BY NEGLIGENCE OR ANY OTHER CAUSE.
